Welcome to Haitian Lyhood Marketplace. By accessing or using our platform, you agree to comply with and be bound by these Terms of Service. Our mission is to empower Haitian entrepreneurs and provide a secure, reliable marketplace for buyers worldwide. Please read these terms carefully, as they govern your legal relationship with us and define the rules for participating in our community.
2. User Eligibility & Registration
To access the Haitian Lyhood Marketplace, users must be at least 18 years of age or the age of legal majority in their jurisdiction. By registering an account, you represent and warrant that you have the legal capacity to enter into a binding agreement. Entrepreneurs must provide valid business information relevant to their operations in Haiti or the diaspora.
Account registration requires providing accurate, current, and complete information, including a valid email address and contact details. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to suspend or terminate accounts that provide false information or violate our safety standards.
3. Acceptable Use & Conduct
All users encounter a standard of excellence. You agree to use the Haitian Lyhood Marketplace only for lawful purposes. Prohibited conduct includes, but is not limited to: posting fraudulent listings, infringing on intellectual property, harassing other members, or attempting to compromise the platform’s security. We maintain a zero-tolerance policy for activities that undermine the trust of our community of Haitian entrepreneurs and global buyers. Failure to comply with these rules may lead to immediate account suspension or termination.
4. Payments & Refund Policies
All financial transactions on our platform are processed through secure, encrypted payment systems. By completing a purchase, you agree that marketplace service fees are non-refundable and that sellers are paid based on our internal disbursement schedule. Independent business owners are responsible for establishing their own tax and shipping rates.
Our refund and return procedures depend on the product source. If an item is sold or supplied directly by Haitian Lyhood to a buyer or reseller, we manage the return process according to our platform’s refund policy. For items sold and delivered by an independent merchant, that specific merchant is solely responsible for handling refunds and returns under their own business terms. While Haitian Lyhood can help facilitate dialogue between parties to resolve issues, we do not have authority over or control the final refund decisions made by independent merchants.
5. Intellectual Property Rights
All content available on the Haitian Lyhood Marketplace, including but not limited to logos, trademarks, text, graphics, and software, is the exclusive property of the marketplace or its licensors and is protected by intellectual property laws. Users retain ownership of the original content they upload (such as product photos and descriptions), but grant the Marketplace a worldwide, royalty-free license to use, display, and promote such content to facilitate transactions. Any unauthorized use of our brand or the intellectual property of our entrepreneurs is strictly prohibited and may result in account termination and legal action.
Dispute Policies and Liabilities
This section applies to all users of Haitian Lyhood Marketplace, including merchants, resellers, and individual buyers. Haitian Lyhood is responsible for product quality, refunds, and returns only for items it sells or supplies directly to buyers or resellers. Independent merchants are solely responsible for quality, refunds, and returns for items they list and supply themselves. Disputes regarding merchant-supplied products must be settled between the buyer and the merchant. Disputes concerning products supplied by Haitian Lyhood are handled between the buyer and Haitian Lyhood. Any legal disagreements shall be settled through mediation in Port-au-Prince.
